Terms of Service

These Terms of Service (“Terms”) govern your use of Thoughtful (the “Service”). By using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 13 years old (16 in the EEA/UK) to use the Service. You are responsible for activity that happens under your account and for keeping your sign-in credentials secure.

2. Your content

You retain ownership of the content you put into the Service: the people in your care circle, occasions, photos, writing samples, and generated cards. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content for the limited purpose of operating and improving the Service for you.

You represent that you have the right to share the content you put into the Service, including any photos or writing samples of other people, and that doing so does not violate the rights of any third party.

3. AI-generated content

Cards produced by the Service are generated by an AI model based on the inputs you provide. Output may be inaccurate, generic, or unintentionally similar to other content; review and edit cards before sending them. Subject to these Terms, you own the cards you generate and may use them for personal, non-commercial purposes.

4. Acceptable use

You agree not to use the Service to:

  • generate harassing, threatening, or harmful content;
  • impersonate another person or misrepresent your identity;
  • attempt to extract, reverse-engineer, or jailbreak the AI model;
  • scrape, overload, or otherwise abuse the Service or its API;
  • violate applicable law or the rights of others.

We may suspend or terminate accounts that violate these Terms or that pose a risk to the Service or other users.

5. Subscriptions and billing

Paid plans renew automatically until canceled. iOS subscriptions are billed by Apple under the App Store’s standard subscription terms; manage or cancel them in your Apple ID account settings. Web subscriptions are billed by our payment processor. Unless required by law, fees are non-refundable.

6. Termination

You can stop using the Service and delete your account at any time. We may terminate or suspend your access for violations of these Terms or if we discontinue the Service. Provisions that by their nature should survive (ownership, disclaimers, limits of liability, dispute resolution) survive termination.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your expectations.

8. Limitation of liability

To the maximum extent permitted by law, Thoughtful and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose, or USD $100, whichever is greater.

9. Indemnity

You agree to indemnify and hold harmless Thoughtful from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of any third-party right.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable consumer-protection law provides otherwise.

11. Changes

We may update these Terms from time to time. We will post the updated Terms here with a new effective date and, for material changes, give you reasonable notice. Continuing to use the Service after the changes take effect means you accept the new Terms.
